Master Service Agreement

Mike The Mac Guy, LLC / Effective Date: [01/01/2025] 

  1. Overview

This Master Service Agreement (“Agreement”) governs all services provided by Mike The Mac Guy, LLC (“Company”) to the client (“Client”). By requesting or using services, Client agrees to the terms below.

Where a separate service agreement exists — such as the CommandCare Managed Services Agreement — that agreement governs its specific services. This Agreement applies to all other engagements.

  1. Services

Mike The Mac Guy provides Apple-focused technical support to residential and commercial clients in Venice, Sarasota, and Bradenton, FL. Services include:

  • Apple device setup, configuration, and troubleshooting (Mac, iPhone, iPad, Apple Watch, and related accessories)
  • macOS, iOS, and iPadOS support and optimization
  • Home networking setup and troubleshooting
  • Smart home device setup and integration
  • Printer setup and connectivity
  • Data backup guidance, management, and recovery assistance
  • iCloud and Apple ID support
  • Cybersecurity guidance and malware removal
  • Remote and on-site technical support
  • Consulting, training, and personalized assistance
  • Managed support services, including CommandCare plans

All services are performed with professional care and current industry best practices.

Note: Mike The Mac Guy does not perform physical repairs on-site. Concierge service to an Apple Authorized repair facility is available upon request.

  1. Rates and Payment

Standard service rates:

  • On-site support: $150/hr (1-hour minimum)
  • Remote support: $100/hr (30-minute minimum)

Payment is due upon receipt of invoice unless otherwise agreed in writing. Accepted payment methods:

  • Cash
  • Check
  • Credit card (Visa, Mastercard, American Express)

Note: Debit cards are not accepted.

For electronic billing, credit card or ACH (bank transfer) payments can be set up through the client portal: billing.mikethemacguy.com.

Failure to maintain current payment status may result in suspension of services until resolved.

  1. Managed Service Plans

Clients enrolled in CommandCare or other managed service plans receive ongoing support billed on a recurring basis. Plan terms, included services, and cancellation conditions are defined in the CommandCare Managed Services Agreement.

Managed services automatically renew each billing cycle unless cancelled with written notice. Services remain active through the paid period.

  1. Remote Access Authorization

Mike The Mac Guy may access a client’s device remotely to diagnose or resolve issues. Remote access is performed only with the client’s explicit authorization and solely for support purposes.

Remote sessions are never used for unauthorized access or activity. Clients may revoke access at any time.

  1. Data Protection and Backup Responsibility

While Mike The Mac Guy takes reasonable precautions to avoid data loss, technology systems can fail unexpectedly. Client is ultimately responsible for maintaining current backups of their data.

Mike The Mac Guy is not liable for data loss, corruption, or recovery limitations resulting from hardware failure, software issues, or other factors beyond reasonable control. Backup solutions can be recommended and configured as part of service.

  1. Warranty Disclaimer

Services are performed using reasonable care, skill, and accepted industry practices. Due to the nature of technology, specific outcomes cannot always be guaranteed. Mike The Mac Guy does not warrant that all issues will be fully resolved or that future problems will not occur.

No warranties are provided on third-party hardware, software, or services. Applicable manufacturer warranties remain the responsibility of the original manufacturer.

  1. Limitation of Liability

Mike The Mac Guy shall not be liable for indirect, incidental, or consequential damages — including loss of data, productivity, or business interruption.

For general service engagements, total liability shall not exceed the amount paid for the specific service in question. For managed service clients, total liability shall not exceed the amount paid during the three months immediately preceding the claim.

  1. Client Responsibilities

Client agrees to:

  • Provide accurate and complete information when requesting support
  • Maintain current data backups
  • Provide access to devices when needed
  • Maintain a valid payment method for recurring services
  • Notify Mike The Mac Guy of any changes to enrolled devices or account information
  1. Termination

Either party may terminate this Agreement at any time with written notice. Any outstanding balances remain due and payable upon termination.

Managed service plans remain active through the end of the paid billing period regardless of when notice is given. Annual plans are non-refundable upon cancellation.

  1. Amendments

Mike The Mac Guy reserves the right to update this Agreement at any time. Clients will be notified of material changes. Continued use of services following notice constitutes acceptance of the updated terms.

  1. Governing Law

This Agreement is governed by and interpreted in accordance with the laws of the State of Florida. Any disputes arising under this Agreement shall be resolved in the appropriate courts of Sarasota County, Florida.

  1. Agreement Acceptance

By requesting or using services from Mike The Mac Guy, Client acknowledges that they have read, understood, and agree to this Master Service Agreement.
